The word after the meeting last night is that Mr. David Lang is no longer an employee of the City of Ortonville.

The deliberations regarding this issue were lengthy and the decision is final.

This position is an extremely important in the current government organization.

The voters will recall that this site has pointed to a one-sided contract negogiated by the last adminsstration.

The Mayor and existing council heard the voters during the last election and have made some of the changes the voter's were looking for.

I think most citizens think this is a positive step in the right direction.

The contract below states that David Lang will get 6 months pay.

David Lang was hired on April 4, 2007 at a pay scale of $43,273.23
RESOLUTION 07-032

RESOLUTION OFFERING EMPLOYMENT PACKAGE TO CLERK-ADMINISTRATOR APPLICANT
BE IT AND IT IS HEREBY RESOLVED that the Council of the City of Ortonville, Minnesota, offer David Lang the following employment package:
Salary-Grade 10 Step 4 - $43,273.23
2 weeks of Vacation
1 day per month Sick Leave
Group Dental Insurance
Group Double Indemnity Term Life Insurance Policy
$468.00 payment toward Health Insurance

Upon roll call vote the following voted aye: Anderson, Dorry, Meyer, Cunningham , Johnson and the following voted nay: Oakes, Arndt.
Resolution 07-032 passed this 4th day of April 2007.

Resolution 07-033 was voted on April 10, 2007

Seven months later he was given a $10,000.00 pay raise. The new contract raised his pay to $54,631.45 and stated that he would get six months pay if he was ever terminated. In 2008 he was paid almost $61,000.00 plus cafeteria expense which would add another $6,000.00 making a total of over $67,000.00

If that is the total they half then that would mean that David Lang will get somewhere in the neighborhood of $33,500.00 according to the contract signed by Blair Johnson and Dan Oakes.

Let's see if this adds up.
Start job in April of 07 at............................... $43,000.00
Seven months later a new contract of............. $54,000.00
In 2008 he is paid ........................................ $67,000.00
No Clue what he was paid in 2009................... $??,???.??

Are these figures correct? In a period of 19 months (about a year and a half) he was given an increase of $24,000.00? I was never very good with figures. What percentage pay raise is that anyway?

Now the people have to pay what.....$30,000.00 to have him leave? Why not take it out of the pockets of the men who made the contract. If they think he was worth it maybe they should pay for it?

That is a lot of money for the people to be paying for a clerk who was not very good in his job. Should the people thank Blair Johnson and Dan Oakes for binding the taxpayers to such an agreement? Is a debt of gratitude due to City Attorney Craig Ash for the contract?

Wait a minute. Is that a loop hole I see in the contract? Detective On line 16 under Termination Benefits it says:

In the event that Employee is terminated by the Employer during such time that the Employee is willing and able to perform the duties of City Clerk-Administrator.....

Isn't that why they let him go....because he wasn't able to do the job?
Aside from the incompetence of his job performance that he wasn't able to do there is the matter of not living in Ortonville according to city policy. He is not able to work as City Clerk/Administrator because he lives outside the city limits. Therefore the contract is null.

I say don't pay. judge

Ortonville Independent has some info -- didn't make the paper as it meeting was held after they print the paper (apparently).

I had reviewed the article but attempted to be informative instead of kicking a dog when he is down.

I did find that Craig Randleman is finding himself on the wrong side of these issues. He should really examine his loyalties a little better.
